General Sales Conditions

The offer and sale of products on our E-commerce platform are governed by the following general conditions (hereinafter "General Conditions"), which regulate the relationship between Atelier Cosmetico S.r.l. with registered office at Viale Armando Diaz, 41, Bassano del Grappa - 36061 (VI), certified email address ateliercosmetico@pec.it, VAT number 04460120241, represented by the President and CEO, Dr. Francesca DAMATO, email ateliercosmetico@pec.it (hereinafter "Atelier Cosmetico") and the Customer.

1. Definitions

The terms and expressions listed below have the specified meanings; it is understood that terms defined in the singular also apply to the plural and vice versa:

• Consumer: any natural person who uses the E-commerce for purposes not attributable to any entrepreneurial, commercial, artisanal, or professional activity, aged 18 (eighteen) or older.

• Customer: any Consumer who purchases one or more Products through the E-commerce, in accordance with the General Conditions.

• E-commerce: refers to the virtual store available at the URL https://www.ateliercosmetico.it/, through which it is possible to purchase Products or Services.

• Parts: refers to Atelier Cosmetico and the Customer collectively.

• Products or Services: refers to the items offered in the E-commerce for sale.

• Personal Area: refers to that part of the E-commerce, exclusively for the Customer's use, through which the Customer can access specific functions provided by Atelier Cosmetico, after authentication.

• Website: refers to the following website:

1. Object

The General Conditions regulate the online sale of Products or Services by Atelier Cosmetico to the Customer. The essential characteristics of the Products or Services are described in each product sheet provided in the E-commerce. The images and colors of the Products reproduce as faithfully as possible the real characteristics of the Products. In any case, the images are shown for illustrative purposes only and may not fully correspond to reality, also for technical reasons. Consequently, Atelier Cosmetico cannot be held responsible for any inadequacy of the images of the Products shown on the E-commerce, if due to the aforementioned technical reasons. Atelier Cosmetico will do its best to ensure that the reviews of the Products published by users on the Website are actually Consumers who have purchased and/or used the Products and Services. Reviews published on the Website may not be fully verified and/or correspond completely to reality, also for technical reasons. Atelier Cosmetico offers the sale of its Products, Services, and conducts its online sales exclusively to Customers who are Consumers. If the Customer is not a Consumer, they are invited to refrain from making any purchases through the E-commerce. In accordance with its commercial policy, Atelier Cosmetico reserves the right not to process any order not coming from a Consumer or, in any case, orders not in compliance with its commercial policy, at its sole discretion. Information on the range of Products and Services sold through the E-commerce is available, with references to the Products, on the Website. In any case, Atelier Cosmetico reserves the right not to accept orders that appear unusual in relation to the quantity of Products purchased or the frequency of purchases. The Customer is expressly prohibited from reselling, renting, leasing, transferring for any commercial and/or professional purpose the Products purchased on the E-commerce.

1. Conclusion of Purchase

3.1 Registration: To purchase the Products and Services provided by the E-commerce, it is possible to proceed with registration or as a guest user. To register, the Customer must carefully fill out and submit the appropriate form through the tools made available, entering their personal data in the appropriate fields. The Customer ensures that the information and personal data provided during the registration process and at a later stage are complete and truthful.

Registration will be effective only when the Customer receives the confirmation email and opens the link contained in it. At the end of this procedure, a Personal Area will be created for the Customer, who can view their purchases, check their wish list, and modify their credentials. Registration credentials, as well as access to the Personal Area, will be used exclusively by the Customer and will never be transferred to third parties. The Customer undertakes to keep them confidential and to take every appropriate security measure to minimize the risk of any unauthorized, prohibited access to the Personal Area, promptly reporting to Atelier Cosmetico whenever they suspect misuse or unauthorized access to the Personal Area.

3.2 Conclusion of Purchase: After registration, it will be possible to start the purchase procedure. Before proceeding, the Customer must read the General Conditions, paying particular attention to the withdrawal clauses, and print a paper copy and save a copy on a permanent storage device that allows the Customer to retain the information for a suitable period of time and reproduce the stored data identically.

To purchase the Products on the E-commerce, the Customer must complete the electronic order form and transmit it to Atelier Cosmetico, electronically, following the instructions provided on the E-commerce. Before submitting the order form, the Customer must identify and correct any errors in the data entry, verifying the chosen Product. In case the data is not correct, it can be modified by clicking the "modify data" button. In any case, to better protect the Customer, Atelier Cosmetico will send them an order confirmation email with a summary of the information contained in the order form. The Customer must verify the delivery of the documentation, checking, if necessary, their spam folder. The Customer must also verify the final price before submitting the order form, and the price applied to the Product will be the one displayed on the Website at the time of the Customer's order.

The contract for the purchase of the selected Product(s), with full application and effectiveness of the General Conditions, will be considered concluded when Atelier Cosmetico receives payment from the Customer, after the electronic transmission of the duly completed order form.

By submitting the order form and paying the due amount, the Customer confirms that they have understood the General Conditions, as well as any additional information provided on the E-commerce. Upon the conclusion of the purchase under the General Conditions, Atelier Cosmetico will process the purchase order. The languages available for the conclusion of the General Conditions are: Italian.

Occasionally, inconveniences related to the availability of some Products may occur. In such circumstances, Atelier Cosmetico will promptly inform the Customer via email and offer them the opportunity to choose between purchasing an item of the same nature as the one no longer available or canceling the order. If the Customer chooses to cancel the order, they will be promptly refunded.

1. Order Availability

For each Product included in the E-commerce, Atelier Cosmetico indicates whether:

• It is available in its warehouse;

• It is not available in its warehouse;

• It is available on request.

Atelier Cosmetico expressly reserves the right not to indicate the availability of the Products included in the E-commerce. The type and availability of the Products may change at any time without any liability on the part of Atelier Cosmetico towards the Customer. The indication of the availability of the Products is not binding, provided that Products indicated as "not available" cannot be ordered by the Customer. Atelier Cosmetico cannot process purchase orders that include incomplete or untrue data or in the case of an unavailable Product. If the Products ordered are unavailable, Atelier Cosmetico will notify the Customer by email, within 15 (fifteen) days of receipt of the order. In the event of an error in the indication of the availability of the Products, Atelier Cosmetico will promptly inform the Customer, allowing them to cancel the order.

1. Prices and Payment Methods

5.1 Prices: The prices of the Products are inclusive of all taxes and duties. Shipping costs are indicated separately during the purchase process before the Customer completes the order. Prices may be subject to change at any time, without notice, except for the price changes already published on the Website. The Customer is advised to check the final sale price before submitting the order form.

5.2 Payment methods: The Customer can pay the price of the Products and the related delivery costs by credit card, bank transfer, PayPal, and any other means of payment indicated on the E-commerce at the time of purchase. The Customer's credit card details will be processed through a secure server-to-server connection using the SSL (Secure Socket Layer) protocol, to ensure maximum security. Credit card information is never visible to Atelier Cosmetico and is not stored by Atelier Cosmetico in any database. If the Customer chooses to pay by bank transfer, Atelier Cosmetico will provide the Customer with the bank details for the payment.

5.3 Invoice: At the time of purchase, the Customer may request the issuance of an invoice for the purchased Products, by selecting the appropriate option during the purchase process and entering the required data. The invoice will be sent to the Customer via email.

5.4 Payment validation: To ensure maximum security in online transactions, Atelier Cosmetico reserves the right to ask the Customer for additional information or to send copies of documents proving ownership of the card used. In the absence of the required documentation, Atelier Cosmetico reserves the right not to accept the order.

5.5 Payment default: In case of non-payment by the Customer, Atelier Cosmetico reserves the right not to process the order and not to make the delivery of the Products.

5.6 Payment processing: Payments made through the E-commerce are processed by third-party payment service providers. Atelier Cosmetico does not have access to the payment data provided by the Customer.

1. Delivery Methods and Costs

6.1 Delivery methods: Atelier Cosmetico delivers the Products to the address indicated by the Customer in the order form, by courier or other means deemed appropriate by Atelier Cosmetico. Atelier Cosmetico will deliver the Products to the address indicated in the order form. The Customer is required to provide accurate and complete address details for the delivery of the Products.

6.2 Delivery costs: The costs of delivery of the Products are indicated separately during the purchase process before the Customer completes the order.

6.3 Delivery times: The delivery times of the Products are indicative and may vary based on the destination address. Atelier Cosmetico undertakes to deliver the Products within 30 (thirty) days from the conclusion of the contract. If Atelier Cosmetico is unable to deliver the Products within the specified period, it will inform the Customer by email and provide the option to cancel the order or accept a new delivery date. In the event of cancellation, Atelier Cosmetico will refund the Customer within 14 (fourteen) days from the cancellation date.

6.4 Delivery verification: Upon delivery of the Products, the Customer is required to verify that the packaging is intact, not damaged, or wet and, in any case, conforms to the standard characteristics of the Products. Any damage to the packaging and/or the Products or the mismatch in the number of packages must be immediately notified in writing on the courier's delivery note. Once the courier's document has been signed without making any objection, the Customer cannot make any objection about the external characteristics of the delivered items. Any problems related to the physical integrity, correspondence, or completeness of the Products received must be reported within 14 (fourteen) days of delivery by sending an email to Atelier Cosmetico at the following address: ateliercosmetico@pec.it.

1. Right of Withdrawal

7.1 Right of Withdrawal: The Consumer has the right to withdraw from the contract concluded with Atelier Cosmetico within 14 (fourteen) days from the day the Consumer or a third party, other than the carrier and designated by the Consumer, acquires physical possession of the Products.

7.2 Exercise of the right of withdrawal: To exercise the right of withdrawal, the Consumer must inform Atelier Cosmetico of their decision by an explicit declaration (for example, a letter sent by post, fax, or email) to the following address:

The Consumer may use the withdrawal form attached to these General Conditions, but it is not mandatory.

7.4 Effects of withdrawal: If the Consumer withdraws from this contract, Atelier Cosmetico will refund all payments received from the Consumer, including the costs of delivery, without undue delay and in any event not later than 14 (fourteen) days from the day on which Atelier Cosmetico is informed of the Consumer's decision to withdraw from this contract. Atelier Cosmetico will carry out such reimbursement using the same means of payment as the Consumer used for the initial transaction unless the Consumer has expressly agreed otherwise. In any case, the Consumer will not incur any fees as a result of such reimbursement.

7.5 Return of the Products: The Consumer must return the Products to Atelier Cosmetico without undue delay and in any event not later than 14 (fourteen) days from the day on which the Consumer communicates their withdrawal from this contract to Atelier Cosmetico. The deadline is met if the Consumer sends back the Products before the period of 14 (fourteen) days has expired. The Consumer will bear the direct cost of returning the Products. The Consumer is only responsible for the decrease in the value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics, and functioning of the goods.
